1. Agreement to Terms

By accessing or using SwaplyX services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Description of Services

SwaplyX operates as a cryptocurrency on-ramp aggregation platform. Our services include:

• Aggregating and comparing rates from multiple cryptocurrency on-ramp providers
• Facilitating connections between users and third-party on-ramp service providers
• Providing individual and business on-ramp solutions
• Offering merchant integration and API services

Important: SwaplyX is not a financial institution and does not directly process cryptocurrency purchases. All transactions are completed through our vetted third-party provider partners.

3. Eligibility

To use SwaplyX services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• Not be listed on any U.S. Government list of prohibited or restricted parties
• Comply with all applicable local, state, national, and international laws

4. Account Registration and KYC/KYB

When creating an account with SwaplyX, you must provide accurate, complete, and current information. You agree to:

• Complete the required Know Your Customer (KYC) or Know Your Business (KYB) verification process
• Provide government-issued identification and other documentation as requested
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept full responsibility for all activities that occur under your account

5. Fees and Payments

Transaction fees vary depending on the selected provider, payment method, and transaction amount. All fees are clearly displayed before you confirm your transaction. You are responsible for any additional fees charged by your bank, payment provider, or blockchain network. Fees are non-refundable except as required by law or as outlined in our refund policy.

6. Prohibited Activities

You agree not to:

• Use our services for any illegal purpose or in violation of any laws
• Engage in money laundering, terrorist financing, or other financial crimes
• Provide false, inaccurate, or misleading information
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Interfere with or disrupt our services or servers
• Attempt to gain unauthorized access to any portion of our services
• Use automated systems or software to extract data from our services

7. Risk Disclosure

Cryptocurrency transactions carry inherent risks. By using our services, you acknowledge and accept that:

• Cryptocurrency values are highly volatile and can change rapidly
• Transactions on blockchain networks are generally irreversible
• You may lose some or all of the value of your cryptocurrency
• Regulatory changes may affect the value and legality of cryptocurrency
• Technical issues may delay or prevent transactions

8. Limitation of Liability

To the maximum extent permitted by law, SwaplyX and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

9. Indemnification

You agree to indemnify, defend, and hold harmless SwaplyX and its affiliates from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of our services, violation of these Terms, or violation of any rights of a third party.

10. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SwaplyX is registered, without regard to its conflict of law provisions.
